(Daily Mail Reporter) – The topless model from one of Peter Beard’s most iconic prints is suing the photographer for making money from her image while she remains ‘destitute’.

Prints of the photograph of Fayel Tall near Lake Rudolph in Kenya have sold for tens of thousands of dollars at auction.

Fayel Tall, who posed bare-chested for the striking shot at age 17, has accused the photographer of selling pictures of her for hundreds of thousands of dollars without her permission. In the suit filed at Manhattan Federal Court, she said he had violated a 10-year contract that expired last year by continuing to sell her ‘very sought after’ and ‘iconic’ image. Ms Tall claims she has not received any money for the images taken by the 73-year-old photographer who became famous for his distinctive shots of wildlife in Africa and supermodels. When Peter Beard photographed the model near Lake Rudolph in Kenya in 1987, the young African woman says she thought no one would ever see the portrait.

But in 1997 she discovered the image when working in a boutique in Los Angeles. In court papers, Ms Tall claimed that the topless photo has made Mr Beard ‘tremendous profits’. One copy of the photo recently fetched nearly $104,000 at auction. Ms Tall said that despite having appeared in international fashion magazines and a Janet Jackson video she now has nothing. ‘In the years that have elapsed from the taking of the iconic photographs, [Tall] finds herself living in New York, destitute,’ the documents read. Photos of Ms Tall taken by Mr Beard have appeared in Elle, Vogue and Marie Claire magazines. The Kenyan-born model wants more than $1 million in damages.

(Daily Mail Reporter) – A woman died after an out-of-control SUV crashed into her home as she answered the door.

The elderly woman was trapped under the Nissan Pathfinder for 48 minutes before being taken to hospital where she died. Her neighbor John Pappas, 53, said he was knocking at the door to check on Mrs Turner when the vehicle suddenly appeared. ‘I heard a screech and I turned around and I saw a car coming, and it was coming right at us,’ Mr Pappas, told local station Fox 25.‘Seemed like it was airborne at the end there. You couldn’t have aimed better if you tried. Freakish thing.’ Mr Pappas managed to jump out of the way and escaped with only a broken ankle, but Mrs Turner, who had just opened the door was fatally injured.

The driver of the car, Hari Dhakal, said he was trying to stop the vehicle just before the accident, but believes his brakes failed. ‘There was something wrong with the brake. I jammed the brake. And the car didn’t stop,’ he told Fox 25. He added that he does not believe he was pressing the gas pedal instead of the brake. Mr Dhakal, who is a father-of-two said he was driving to pick up his wife at the time and drives down the road every day. Police said alcohol was not involved in the crash, but said speed may have played a part. Sean Maher, a family friend of Mrs Turner, said she was expected to turn 84 in a few weeks. He questioned the speed of the driver. He said: ‘He had to be going pretty fast to go 12 feet airborne and make it to where he made it. ‘It’s a sad, sad, sad end for her.’

(Phoenix New Times By James King) – ​Arizona is well-known as a corridor for smuggling marijuana, and out-of-towners often like to take home a souvenir. Weed, however, is not allowed on airplanes, so stoners are occasionally forced to mail their cannabinoid keepsakes to their out of state homes. When doing this, it’s important to get the address right — otherwise, your weed could end up in the hands of senior citizens.

Police in Upper Darby, Pennsylvania, say an elderly couple received a package in the mail last week from an Arizona address with which they weren’t familiar. Inside: a big brick of weed. Initially, the couple left the package on their front porch because they didn’t know the person to whom it was addressed, and they assumed it would be picked up. After a few days, the package was still there, so the couple opened it and found what many people would consider a godsend: five pounds of weed with an estimated street value of about $10,000. The couple turned over the marijuana to police who determined the Arizona return address was a fake, and the package — shockingly — originated somewhere else. Last summer, an elderly woman in Michigan received a similar package. That one was from Arizona. As Blackman Township, Michigan, police Sergeant Rich White explained to New Times at the time, he was hip to Arizona’s status as America’s weed-distribution center. Below is how our conversation with White played out:

“Heard an old lady had a bunch of weed sent to her house?” we asked White.

“Yeah, a little bit,” he says.

“Two pounds of weed is more than a little bit,” we explained.

“Not coming from you guys [Arizona, not New Times] it’s not,” White joked.

The theory, White explained, is that the sender mailed the weed to the wrong address or had it mailed to the old woman’s house with plans that someone would steal it from her mailbox before she had a chance to get the mail.

(Daily Mail Reporter) – A Muslim waiter at the Waldorf-Astoria hotel named Mohamed said he was forced to wear a name badge with ‘Edgar’ on it to stop guests being scared.

Mohamed Kotbi is suing the Waldorf Astoria hotel in New York for racism after he was asked to wear badges with different names on.

Mohamed Kotbi is suing the New York hotel for racism after he was asked to wear badges with different names on to prevent customers being frightened of being served by someone named Mohamed. The Moroccan-born banquet waiter said he was first asked to change his name badge to one that said ‘John’ on September 11 2001, after the attacks on the World Trade Center.  ‘I put it on. I was in shock,’ the Muslim man told the New York Post. When Mr Kotbi, who has worked for the hotel since December 1984, complained to the hotel management, he was told, ‘We don’t want to scare our guests’.

He filed discrimination suits with the Equal Employment Opportunity Commission in 2005 and 2009, and was given a name tag with his surname on it. But in November, he was given a name badge that said ‘Edgar’. When he spoke to his manager, he was told, ‘It’s better to be Edgar than Mohamed today’. Mr Kotbi is suing the hotel for religious and racial discrimination. In court documents, he accuses the hotel of creating a ‘hostile work environment’ and failing to stop bullying from colleagues. He alleges that he has been repeatedly called ‘terrorist’ and ‘al Qaeda boy’. Mr Kotbi said: ‘It’s like I’m guilty, like I did the attacks on September 11.’ Lawyer Jonathan Bell said his client is a ‘family man’ and ‘can’t afford to just up and leave’.

“Usually, I’ll get up to go to the kitchen and start dinner. At that point, I’m transported to the home of my parents (who passed away in 1979) and we share some happy moments. Then I go back home and finish cooking for the children. The part that puzzles me the most is that my husband (who died in 1987) never appears in any of my dreams! Thank you for any thoughts you may have. I think it’s just my mind replaying some of the better moments in my life. But my husband was wonderful before he got sick. I don’t understand why he’s never there.”

Hi Carolyn,

First of all, I am sorry to hear about the loss of your child. That is a tough one, no matter what age the child was at passing. Although the pain may soften through time, there is often hurt that lingers.I think that you are correct in your idea that your mind is replaying some happy moments, but there may be additional emotional information. The fact that your parents were also in the dream may represent you and your husband as parents as well as your link to your own family of origin. Cooking is an expression of nurturance and the dream may be a nurturing thing for you or an indication that you may need a little more nourishment, either emotional or spiritual.

The interpretation of why not dream about your husband can take several turns. A lot depends on what one believes. There is a notion that the spirits of our loved ones visit in dreams and those whom we are very attached to may have trouble contacting us because of the depth of feeling associated with them. Dream symbols often show up in code and your husband may actually show up as someone else or something that symbolizes your relationship or him. Think about some other dreams and it may come to you.

The “Do Not Ask Me or Tell Me” List - by Michael Cohen aka Mucho Groucho

A few years back Congress passed a “do not call” list bill, outlawing the constant harassing sales calls that interrupted our lives at the absolute most inconvenient times possible, which for me is the period of 6 or 7 hours of napping I do during the day, every day before I go to sleep for the night.

I am proposing another list I would like to see implemented called: the “don’t ask me, don’t tell me” list which will prevent customer service reps and other agents of torture from engaging in the corporate language they use when dealing with us on a daily basis. If they interrogated the prisoners at Guantanamo Bay, using that same antiseptic, robotic, blood curdling language, we would have won the war against terror years ago.

“We can offer you our Triple Pay package for $99.00 a month and I will read you the terms that should only take about 20 minutes or so, or perhaps you would like to tell me when the next terror attack is scheduled to take place or where Osama Bin Laden is hiding? Ok. As you wish. This is a two year contract commencing…..”

This “do not ask or tell me” list is not limited to the telephone. For instance it also applies to the 17 year old gum chewing, friend texting grocery cashier who “axes” me if I would like a bag for the 30 items I just bought.

“No, I think I will juggle them while riding my unicycle home. Can you just toss me that can of tuna when I tell you…? Ok…..NOW!!”

This is my list. Feel free to add to it according to your own pet peeves, neurosis, quirks and idiosyncrasies.

After waiting on hold, and then speaking to 3 different people who ask for the same exact information that I entered on my “telephone keypad” a half hour ago, I am told by my Insurance Company agent that I am not covered for that unaffordable, life saving drug I need. I have the option of either paying out of pocket or dying. This is followed with:

1 – “Is there anything else I can help you with?”

“No, I think the prospect of an early death is quite enough for now but can I get your extension just in case because you have been so helpful. What’s your name again? Barbara? Barbara, are you by any chance wearing a long black robe and carrying a reaper’s sickle in your right hand?”

Then they have the nerve to ask:

2 – “Would like to take part in a survey regarding your satisfaction?”

“Yes, I would like to take the survey but I want it to be given by the CEO of your company and there may be some really foul language involved. Can you transfer me to the f-er now?”

3 – “Would you mind holding?”

“Yes, I mind holding. I would like you to bring the phone with you every where you go while trying to get an answer for me and just keep me on the line. I want to hear EVERYTHING that is said and you should know that your call may be recorded for “quality assurance” or training purposes or as Exhibit A when I take you to court.

Last month I didn’t realize there was an actual time of day deadline indicated on my credit card bill on the day the payment was due by. It was 5pm. To me, the day ends at 11:59:59 so at 11:00 PM I felt that I had plenty of time and I made my payment online. Then when I got my bill, I saw that I received a $50 late fee. I was 7 hours late according to their clock; I had a whole 59 minutes and 59 seconds according to mine. When I called this is what the agent told me:

4- “I waived the late fee as a one time courtesy………”

I answered in Brooklynese:

“Oh yeah? How about if I wave my FIST by your FACE

as a one time courtesy warning?!!”

Asked by every hairstylist that ever gave me a $20 hair cut”

5 – “Would you like me to trim the hair off your ears?”

“No, no!! Please don’t!! I am letting it grow out the way my Uncle Stanley’s ear hair did when he was 80 years old. I am also letting the fungus between my toes cultivate because I want to see if any tiny mushrooms might pop out. It’s an experiment.”

And back to the corporate world, the famously ridiculous:

6 – “Would you like to subscribe to our newsletter?”

“No thank you. I learned everything I needed to learn about your company when you denied me coverage for the unaffordable drug that could have saved my life. I won’t be receiving emails in Heaven but I will be petitioning God to strike your CEO with an attack of a pre-existing condition he won’t forget!!”

Irritating song Friday was so bad that teen internet star Rebecca Black was placed under police protection after receiving disturbing death threats. But a singer has re-recorded the song and it has become a viral hit that people actually enjoy, by translating it into Chinese.

R&B performer Dawen took on the infamous song and it seems his acoustic version is a lot more palatable than the heavily auto-tuned original. Fans posted a barrage of praise, or at least preference to the original, on the YouTube video, with comments including, ‘this version is actually alright’. Viewers commented that the much derided lyrics were actually bearable when in a language not understood.

Dawen, who has previously performed with Grammy Award winner Macy, is offering a free download of his version of the song on his website. The original performer of Friday, 13-year-old Rebecca Black, was dubbed the ‘worst singer in the world’, after she shot to fame when the cringe worthy video went viral. It has been viewed more than 125 million times on YouTube, but the strange lyrics and bad vocals were widely mocked. Her mother paid $2,000 to the record label to produce the song and video, which was shot in her father’s home with friends and family as extras.

Miss Black was placed under police protection after she started to receive death threats, which officers said they were taking ‘very seriously’. The teenager admitted that she was shaken by the at times vicious comments she received online. But Miss Black is reported to have earned in the region of $20,000, through YouTube’s revenue-sharing plan, according to Forbes Magazine. She’s also estimated to have made thousands of dollars from iTunes sales. The cast of Glee are expected to perform a version of the single in an upcoming episode.

(Daily Mail Reporter) – One moment he thought he was just an anonymous punter in a backstreet brothel. The next he’s in the nude hanging off a drainpipe after police burst into the brothel he was using in eastern China.

As the doors were smashed down in this backstreet brother, the naked customer ran on to the roof and started to climb down a drainpipe.

As the doors were smashed down the customer, leaving his clothes behind, ran on to the roof of the rundown apartment bloc in Changchun, Jilin province. He then shinned down what appears to be a huge drainpipe and then ran off into the back streets. But he was not alone in making his escape. Moments after he appeared on the roof, two women – one just wrapped in a towel – could be seen running across the roof. Another forlorn customer can be seen hiding behind a packing crate.  China has severe anti-prostitution laws and punishments including the death penalty for anyone guilty of human trafficking.

(Daily Mail Reporter) – As she took to the stage in Ecuador last night, Miley Cyrus appeared as if she has gone to the Taylor Momsen school of fashion.

The 18-year-old pop star came out to perform in a racy black and red leather outfit which left little to the imagination. The actress and singer has returned to work and last night kicked off the start of her Gypsy Heart Tour at the Atahualpa Staduim in Quito, Ecuador. Miley rocked a cropped red leather embellished jacket with black leather hight waisted hot pants, thigh high boots and unusual black suspenders and stockings as she sang and danced her way through the set. She was joined on stage by several equally as racily dressed dancers.

The Hannah Montana star left her home in Los Angeles on Thursday to begin a 20 date tour through South America, The Philippines and Australia. Tweeting to her fans about her first performance of the tour Miley voiced her excitement saying: ‘Honestly I can’t believe my first show is already over.’ ‘Amazinnggg. This crowd was beyond incredible. I cried my eyes out. so touched.’
